Conduct: On 1 February 2021, William Jackson (“Mr Jackson”) caused The Vintage Bath Company Limited to apply for a Bounce Back Loan (“BBL”) of £50,000 using an overstated turnover figure which resulted in The Vintage Bath Company Limited obtaining a BBL that was at least £33,905 more than it was entitled to; in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover; • The Vintage Bath Company Limited was incorporated on 19 August 2019; • On 1 February 2021, Mr Jackson applied for a BBL of £30,000 on behalf of The Vintage Bath Company Limited stating a turnover of £300,000; • On 18 February 2021, Mr Jackson applied for a top-up BBL of £20,000 on behalf of The Vintage Bath Company Limited meaning the total borrowed under the BBL Scheme was £50,000; • Whilst Mr Jackson was permitted to estimate the turnover of the business, accounts signed by Mr Jackson, on 4 February 2021, for the period ended 31 August 2020 showed a turnover of £64,124, and as such Mr Jackson knew, or ought to have known, that the turnover figure of £300,000 was overstated when the BBL application was made; • The Vintage Bath Company Limited received the initial BBL funds of £30,000 on 4 February 2021, and a further £20,000 of BBL funds on 18 February 2021; • At liquidation, a loss of £50,798 in respect of the BBL was owed to the Bank.
