Conduct: Mr Mohammed Balayet Khan (“Mr Khan”), caused London Coffee & Juice Café Ltd (“LCJC”) to apply for a Bounce Back Loan (“BBL”) in the sum of £50,000 using overestimated turnover figures when Mr Khan knew or ought to have known that LCJC was not eligible for a BBL of that amount, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover from the date the business started. • LCJC was incorporated on 8 August 2019 and, according to Mr Khan, commenced trading August 2019. • The Liquidator analysis of the Bank Statements up to the 27 May 2020, show receipts totalling £17,722.52. This level of trading income is equivalent to an annual turnover of approximately of £26,583 • By 27 May 2020, the company had been trading for over 8 months, and this should reasonably have informed any turnover estimate provided in support of the application. Accordingly, the company was entitled to a BBL of no more than £6,646 and received £43,354 more than it was entitled to. • On the 27 May 2020 Mr Khan submitted a BBL application declaring an estimated annual turnover of £210,000. • On the 22 June 2020 Mr Khan signed the BBL agreement. • On the 23 June 2020 LCJC received BBL funds of £50,000. • At liquidation, the company’s total liabilities amounted to £60,252, of which £49,143 related to the outstanding BBL.
