Conduct: On 13 May 2020 Mr Khakbazi caused Leto Burger Limited (“Leto”) to overestimate its turnover on a Bounce Back Loan (“BBL”) application when he ought to have known, that Leto was not eligible for the amount received. As a result, Leto received £39,652.55 more than it was entitled to from the BBL scheme, in that: • Under the terms of the BBL scheme, eligible businesses were entitled to borrow between £2,000 and £50,000, up to a maximum of 25% of turnover in the calendar year 2019, which the applicant would self-certify when completing the BBL application. • Where a business did not commence trading until after 01 January 2019, the business was able to estimate turnover on the BBL application form. • Leto was incorporated on 30 July 2019 and Mr Khakbazi states Leto began trading in October 2019. • On 13 May 2020, Mr Khakbazi, whilst the sole director of Leto, submitted a BBL application for £50,000, stating that Leto’s estimated turnover was £210,000. • On 13 May 2020 Mr Khakbazi signed the BBL agreement. • On 14 May 2020 £50,000 BBL funds were paid into the Leto bank account. • A document delivered by Mr Khakbazi to the liquidator shows sales figures between October 2019 and April 2020 totalling £10,742.54, which averages £3,449.15 per month. Based on this monthly figure, Leto’s estimated annual turnover was £41,389.83 which Mr Khakbazi ought to have known would entitle Leto to a BBL of no more than £10,347.45. • Leto’s accounts for the period 30 July 2019 to 31 July 2020 record its turnover as £33,145. Leto's accounts for the period 01 August 2020 to 31 July 2021 record its turnover as £27,103. • Mr Khakbazi has stated that he estimated the 2019 Leto turnover on the estimated 2018 takings of a similar business in the local area where he had previously worked. This company was dissolved at Companies House in October 2019. No accounts for this business were filed at Companies House. • On 11 August 2023, Leto entered Creditors’ Voluntary Liquidation with liabilities of £83,837, of which £40,222 was owed in respect of the BBL.
