Conduct: On 14 May 2020, Marcel Roca (“Mr Roca”) breached the terms of the government backed Bounce Back Loan (“BBL”) Scheme by causing Marcel Delivery Ltd (“Marcel”) to overstate its turnover on its application for a BBL, resulting in the company receiving a BBL of £49,500 when he knew, or ought to have known, that Marcel was not eligible for a loan of that value, in that: • Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% turnover. The turnover figure required was that for the calendar year 2019 or, where a business was established after 01 January 2019, it is the estimated annual turnover from the date the business started to trade. • Marcel was incorporated on 23 July 2019. • Income into company from start of trading in July 2019 to May 2020 totals £23,739. • Financial accounts for period 23 July 2019 to 31 July 2020 showed a turnover of £32,133. • On 14 May 2020, Mr Roca applied for a BBL of £49,500 on behalf of Marcel declaring a turnover figure of £198,000. • On 15 May 2020, BBL funds of £49,500 were paid into Marcel’s bank account. • No evidence has been provided to support the turnover figure of £198,000 declared on the BBL application. • Based on a turnover of £32,133, Marcel was only eligible for a BBL of £8,033 and therefore received £41,467 more than it was entitled to from the BBL scheme. • Repayments made towards the BBL totals £6,365. • On 11 December 2024, Marcel entered Creditors Voluntary Liquidation with known liabilities of £53,373, of which £46,826 was owed in respect of the BBL.
