Conduct: On 07 July 2020, Ventseslav Lyubomirov Stoyanov (“Mr Stoyanov ”), caused VLS Services Ltd (“VLS”) to apply for and obtain a bounce back loan (“BBL”) of £50,000 by overstating VLS' turnover, when he knew or ought to have known that VLS was only entitled to apply for a maximum BBL of £5,709, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure required was that of the calendar year 2019 or where a business was established after 1 January 2019, it is their estimated turnover, provided it was carrying on business on 1 March 2020 and trading at the date of the application. • VLS was incorporated on 16 July 2019. • Mr Stoyanov was the sole director when the BBL application was made and throughout the life of VLS. • On 07 July 2020, Mr Stoyanov applied for a BBL of £50,000, declaring an estimated annual turnover of £219,000. • £50,000 in BBL funds were paid into VLS’ bank account on 24 July 2020. • Accounts for year ending 15 July 2020 show turnover of £22,837. • Accounts for year ending 31 July 2021 show turnover of £25,831. • Using the figures to 15 July 2020 the maximum BBL VLS would be entitled to is £5,709, so it has received £44,291 more than it was entitled to in BBL proceeds. • Total liabilities of VLS at liquidation of VLS are £40,719 of which £37,219 is due to the bank in respect of the BBL.
