Conduct: On 19 May 2020 Jaswant Kaur (“Mrs Kaur”) caused PK Brother Ltd (“PKB”) to apply for a Government-backed Bounce Back Loan (“BBL”) of £50,000 in breach of the terms and conditions of the BBL Scheme by overestimating PKB’s turnover in the BBL application, resulting in PKB receiving more BBL funds than it was entitled to. Furthermore, BBL funds obtained totalling at least £19,000 were not used for the economic benefit of PKB. In that: • The BBL scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019 (or estimated annual turnover from the date it commenced trading if it had been established after 01 January 2019), to a maximum of £50,000. BBL funds were only intended to be used for the economic benefit of the applicant’s business. • PKB was incorporated on 04 July 2019 and commenced trading on or around 13 September 2019 and so, therefore, it was permitted to estimate its income for the purposes of the BBL application. • On 09 May 2020 PKB opened a bank account and on 19 May 2020 Mrs Kaur completed an application form for a BBL, self-certifying that its forecast turnover was £200,000 and requesting a loan of £50,000. • Bank transactions shown by a General Ledger prepared by PKB’s accountants show trading receipts of £30,353 in the period from 13 September 2019 to 18 May 2020 (the day before the BBL was received). • PKB’s accounts for the year ending 31 July 2020 show a turnover of £72,638. Using this turnover figure, PKB would have been entitled to a maximum BBL of £18,160, and therefore it received £31,840 more than it was entitled to. • The £50,000 BBL was received into PKB’s bank account on 26 May 2020. • Immediately prior to the BBL funds being received PKB’s bank account was in credit in the amount of £30.26. Between 26 May 2020 and 28 June 2020, a further £2,367 was credited to the account. • In the same period, payments totalling £17,000 were made from the account to Mrs Kaur. • On 26 May 2020 a payment of £5,000 was made to another individual. • Mrs Kaur has not provided any evidence that the payments totalling at least £19,000 were made for the economic benefit of PKB. • Two repayment instalments were made, by PKB, against the BBL, leaving an amount outstanding totalling £48,333 in relation to the BBL, out of creditors totalling £88,166.
