Conduct: On 12 May 2020, Mr Thavarupan Kandiah (“Mr Kandiah”) caused Heathrow Coaches Limited (“HCL”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by making inaccurate declarations about the companies eligibility for a BBL, or in the alternative, overstating its estimated turnover on the application form, resulting in the company receiving a BBL of £50,000 when he knew, or ought to have known, that the company was not eligible for a loan of that amount, in that: • Under the BBL scheme, businesses were able to apply for a BBL if they were carrying on business on 1 March 2020 and engaged in trading or commercial activity in the UK on the date of the BBL application and had been adversely impacted by Coronavirus. Businesses could apply for a BBL of up to 25% of their 2019 turnover, from a minimum of £2,000 to a maximum of £50,000. Businesses were asked to provide their annual turnover, or if the business was established after 01 January 2019, they were permitted to provide an estimated annual turnover. • HCL was incorporated on 03 July 2019, with Mr Kandiah appointed sole director. • On 12 May 2020 Mr Kandiah applied for a BBL of £50,000 on behalf of HCL, stating an estimated turnover figure of £200,000 on the application form and received the BBL funds of £50,000 on 15 May 2020. • Annual accounts for the year ending 31 July 2020 show a declared turnover of £0. • Tax returns submitted to HMRC for the year ending 31 July 2020 show a declared turnover of £0. • Mr Kandiah has provided no evidence of HCL trading or being engaged in commercial activity at the date of the BBL application on 12 May 2020, nor any evidence in support of the estimated annual turnover figure of £200,000 stated on the BBL application. HCL had achieved a turnover of £0 between incorporation on 03 July 2019 and the date the BBL was applied for on 12 May 2020 and as such was not eligible for a BBL of any amount. • HCL was wound up by court order on 03 September 2025. • At liquidation HCL had liabilities totalling £105,775.25, of which £51,389.81 was owed to the bank in respect of the BBL.
