Conduct: Mr Mehmood breached the terms of the Bounce Back Loan (“BBL”) Scheme by causing Fruity Vapes to overstate its turnover on its application for a BBL resulting in the company receiving a BBL of £50,000 when Mr Mehmood knew or ought to have known that Fruity Vapes was not eligible to apply for the maximum BBL, in that: 6.1 The BBL scheme terms allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which the applicant would self-certify when completing the BBL application. 6.2 If a business was established after 01 January 2019, they were allowed to use an estimate for the 2019 turnover of the company. 6.3 Fruity Vapes was incorporated on 01 July 2019. 6.4 On 9 July 2020, Mr Mehmood declared on the company’s BBL application form an estimated annual turnover of £210,400, and consequently on 10 July 2020 Fruity Vapes received a £50,000 BBL; the maximum loan amount possible under the BBL scheme. 6.5 Company bank statements from 25 April 2019 show that the first transaction on the bank account is 2 October 2019 and between this date and 9 July 2020, the date of the BBL application, the bank statements show the company’s income was £8,872. 6.6 Annual report and unaudited accounts signed by Mr Mehmood in July 2021 for the period 1 July 2019 to 31 July 2020 show the company achieved a turnover of £14,373. 6.7 At the time the BBL was applied for Mr Mehmood knew, or ought to have known, the company could not have achieved the estimated turnover of £210,400. 6.8 Mr Mehmood has provided no evidence that the figure he used on the BBL application was a reasonable or a justifiable estimate. 6.9 By overestimating Fruity Vapes turnover, Mr Mehmood caused Fruity Vapes to receive £50,000 in BBL funds when it was not eligible to receive that amount. 6.10 At liquidation, Fruity Vapes has liabilities totalling £89,690.65, of which £50,533.10 was owed to the bank in respect of the BBL.
