Conduct: On 17 February 2021, Navjot Singh (“Mr Singh”) caused Heartland Construction Ltd (“Heartland”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overestimating its turnover when applying for a BBL. As a result, Heartland received a £50,000 BBL when Mr Singh knew, or ought to have known, that Heartland was not eligible for a loan of any amount. In that: - Under the BBL scheme, businesses could apply for one loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 01 January 2019, an estimated annual turnover could be used from the date trade commenced. - Heartland was incorporated on 28 June 2019, and was therefore allowed to estimate its turnover when applying for a BBL. - On 17 February 2021, Mr Singh applied for a £50,000 BBL on behalf of Heartland, declaring that its estimated annual turnover was £255,000. BBL funds of £50,000 were paid into Heartland’s bank account on 19 February 2021. - Accounts for a dormant company were filed to Companies House for year ending 30 June 2020. - Analysis of its bank statements shows that between 28 June 2019 (date of incorporation) and 17 February 2021 (date of the BBL application), Heartland received one incoming payment of £100 on 16 February 2021. - Director's report and financial statements prepared by Heartland’s Accountants for the accounting years ending 30 June 2021 and 30 June 2022, show Heartland had a turnover of £6,183 and £5,197 respectively. - Based on the turnover stated in the company accounts for year ending 30 June 2021, Heartland was not eligible to apply for a BBL of any amount. - By overestimating its turnover, Heartland received BBL funds of £50,000 to which it was not entitled. - Mr Singh has failed to provide any documentary evidence to support the estimated turnover figure of £255,000 as declared on the BBL application. - On 21 February 2025, Heartland entered Creditors’ Voluntary Liquidation with liabilities totalling £56,000 of which at least £40,956.33 was owed in respect of the BBL.
