Conduct: On 21 May 2020, Cristian Stefan Ulucaru (‘Mr Ulucaru’) caused SIA K9 ENG LTD (‘SKE’) to breach the terms and conditions of the Government backed Bounce Back Loan (‘BBL’) scheme by applying for a BBL of £50,000 when he knew, or ought to have known, that SKE was not eligible for a BBL of that value. Furthermore, Mr Ulucaru failed to ensure that the entirety of the BBL funds were used for the economic benefit of SKE, in that: • Under the BBL scheme, businesses could apply to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which the applicant would self-certify when completing the BBL application. Where a business was established after 01 January 2019, an estimated annual turnover from the date the company started trading could be used.   Businesses could apply for a BBL of between £2,000 and £50,000. • The terms of the BBL scheme stated that the BBL was to be used only for the economic benefit of the company, wholly for business purposes and not personal purposes. • SKE was incorporated at Companies House on 26 June 2019, and the first bank transaction was on 20 August 2019. • On 21 May 2020, Mr Ulucaru applied for a £50,000 BBL declaring turnover of £200,000 on the application form. • Between 26 June 2019 and the BBL application on 21 May 2020, SKE’s turnover shown on the company bank statements was £24,477. For the 12 months following the start of trading on 26 June 2019 SKE’s turnover shown on the company bank statements was £31,531. • Based on the actual turnover, SKE would have been entitled to a maximum BBL of £7,882. Therefore, SKE obtained £42,118 of BBL funds to which it was not entitled. • On 22 May 2020, when SKE received the £50,000 BBL funds into the company bank account, three payments totalling £46,000 were transferred from the SKE account to a second account. Mr Ulucaru has declined to explain these transactions and they are not evidenced as being for the economic benefit of the business. On 25 June 2025, SKE entered Creditors voluntary liquidation. At liquidation, SKE had total liabilities of £56,205, of which £48,579 was owed to Barclays Bank in respect of the BBL.
