Conduct: Rahmanuddin Jabrkhel (“Mr Jabrkhel”) caused Hairstylists (Edgware) Limited(“HEL”) to obtain a Bounce Back Loan (“BBL”) of £50,000 when he knew or ought to have known that it was not entitled, as it was not carrying on its business on 01 March 2020, contrary to the terms and conditions of the BBL scheme. In that: • The BBL Scheme terms and conditions state that applicants applying for a BBL on behalf of the business are required to declare that the business was engaged in trading or commercial activity at the date of the BBL application; had been carrying on business on 01 March 2020 and had been adversely affected by the coronavirus pandemic; • HEL was incorporated on 19 June 2019; • On 04 February 2021 HEL obtained a BBL of £50,000. Mr Jabrkhel declared on the BBL application that HEL’s estimated turnover was £232,110. HEL received the BBL funds of £50,000 on 09 February 2021; • HEL’s accounts for the years ended 30 June 2020 and 30 June 2021 show turnover of nil and £4,493 respectively; • HEL ceased trading around April 2022; • No evidence has been provided to show that HEL was carrying on business on 01 March 2020. HEL therefore obtained a BBL of £50,000 when it was not entitled to a BBL of any amount; • HEL was placed into Creditors Voluntary Liquidation on 27 November 2023; • Total liabilities at liquidation amount to £51,499 of which £50,499 relates to the amount owed in respect of the BBL and interest.
