Conduct: On 19 June 2020 Mr. Adil Jellal (“Mr. Jellal”) caused PBF to apply for a Bounce Back Loan (“BBL”) of £50,000 using overstated turnover figures, which resulted in PBF obtaining a BBL that it was not entitled to. Mr Jellal caused PBF to expend £38,500 of the BBL funds for purposes that did not provide economic benefit to PBF, in breach of the BBL terms and conditions. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. • PBF was incorporated and commenced trading on 19 June 2019 • On 19 June 2020, Mr Jellal applied for a BBL of £50,000 on behalf of PBF declaring that its estimated annual turnover from when the business started was £230,000. • Between 3 March 2020 (the first transaction on PBF’s bank account) and 19 June 2020 credits into PBF’s bank account total £17,144, of this £10,000 was a Local Authority grant and £5,500 was transferred in by Mr. Jellal. PBF’s turnover for this period would have been £1,644, this would have meant PBF was not entitled to a BBL. • PBF received the BBL funds of £50,000 on 22 June 2020, taking its bank account balance to £52,222 in credit. • Mr. Jellal caused PBF to receive a £50,000 BBL that it was not entitled to by overstating its turnover. • Between 30 June 2020 and 21 July 2020 a total of £34,500 net was paid to Mr Jellal and £4,000 was paid to a connected company. Mr Jellal has failed to provide any evidence that the payments were for the economic benefit of PBF. Total liabilities at liquidation amount to £171,987 of which £50,204 relates to the amount claimed in respect of the BBL.
