Conduct: Mr Kirk Pearce (“Mr Pearce”) failed to ensure that NSUK Group Ltd (“NSUK Group”) complied with its statutory obligations to submit statutory returns or to make payments to HMRC as and when they fell due and caused NSUK Group to trade to the detriment of HMRC from at least 07 February 2021 to the cessation of trade on 16 June 2023 in respect of VAT and from at least 22 February 2020 in respect of PAYE, in that: VAT • The total liability in respect of VAT for the periods ended December 2020 to December 2023 was £207,497.52 made up of HMRC Assessments, Surcharges and Interest. • On 07 February 2021 HMRC ledgers show that NSUK Group owed £8,473.00 in respect of VAT. • No payments or returns were made by NSUK Group in this same period. • The total liability outstanding to HMRC for VAT at the end of this period was £207,497.52. PAYE/NIC • The total liability in respect of PAYE/NIC for the periods ended February 2020 to July 2023 was £503,195.05. • On 22 February 2020 NSUK Group was £9,873.31 in debit in respect of PAYE/NIC. • No payments were made by NSUK Group in this same period. • The total liability outstanding to HMRC for PAYE/NIC at the end of this period was £503,195.05. Comparative Treatment • Between 16 July 2021 when available bank statements begin, and the date of Liquidation, the debt to HMRC for VAT and PAYE/NIC increased by £530,056.48. According to HMRC ledgers no payments were received. • Accounts to 30 June 2022 show an annual profit of £198,527.00. • In the same period, £2,197,231.79 was paid out of NSUK Group’s bank account, of which no payments were made to HMRC. • At the date of Liquidation HMRC submitted a final claim of £714,235.22 out of a total estimated deficiency of £1,190,702.01.
