Conduct: On or around 22 June 2020 Ezatullah Alikhel (“Mr Alikhel”) caused Bari Pizzeria Ltd (“Bari”) to breach the terms and conditions of the government-backed Bounce Back Loan (“BBL”) scheme by overstating its estimated turnover figure, when he knew, or ought to have known, that Bari was not eligible for a BBL in that amount. As a result, Bari received more funds than it was entitled to from the BBL scheme. In that: • Under the BBL scheme, a business was able to borrow up to 25% of its turnover for the calendar year 2019, up to a maximum of £50,000. If the business was established after 1 January 2019, it was to use its estimated annual turnover from the date it started. The turnover figure was self-certified by the applicant. • Bari was incorporated on 3 June 2019 and commenced trading on 1 August 2019. • Mr Alikhel was appointed as sole director on 3 June 2019 and remained so until Liquidation. • On or around 22 June 2020, Mr Alikhel applied for a BBL of £50,000 on behalf of Bari, stating in the loan application that Bari’s relevant turnover was £240,000. • Company accounts for the Years Ended 30 June 2020 and 30 June 2021 declare turnover of £48,452 and £37,154 respectively. Therefore, Bari would have been entitled to apply for a maximum BBL of no more than £12,113. • On 23 June 2020, funds of £50,000 were credited to Bari’s bank account. • Bari, therefore, received BBL funds of at least £37,887 to which it was not entitled. • At the date of the liquidation on 13 November 2023, the Statement of Affairs shows that total liabilities amounted to £75,352.99, of which £46,000 was in respect of the BBL.
