Conduct: Zeynep Saglam (“Ms Saglam”) caused Sevenoaks Fish & Chips Limited (“Sevenoaks”) to obtain a Bounce Back Loan (“BBL”) of £50,000 to which it was not entitled, as it was not carrying on its business on 01 March 2020, contrary to the terms and conditions of the BBL scheme. In that: • The BBL Scheme terms and conditions state that applicants applying for a BBL on behalf of the business are required to declare that the business was engaged in trading or commercial activity at the date of the BBL application; had been carrying on business on 01 March 2020 and was engaged in commercial or trading activity on the date of application. • On 10 June 2020, Ms Saglam applied for a BBL of £50,000 on behalf of the company. Ms Saglam declared that Sevenoaks’s estimated turnover was £200,000. • Sevenoaks’s first credit payment was the BBL payment on 25 June 2020. • The company filed dormant accounts signed by Ms Saglam for the period 31 March 2020. • Therefore, Sevenoaks was not carrying on its business 01 March 2020 or on the date of its application, contrary to the terms and conditions of the scheme; and was not entitled to the BBL funds. • Sevenoaks was placed into liquidation on 15 October 2024. • Total liabilities at liquidation amount to £49,844 of which the £47,612 relates to the amount owed in respect of the BBL.
