Conduct: Between 10 February 2020 and 07 April 2022 Matthew Davies-George caused Modern Heritage Construction Limited (Modern) to trade to the detriment of HMRC in respect of VAT and PAYE/NIC resulting in a liability to HMRC of 333,399 (as at the date of liquidation), in that:- VAT Modern registered for VAT with effect from 21 May 2019 On 31 March 2020 a VAT return was submitted for quarter ended 29 February 2020 for 11,654 due for payment in by 07 April 2020. A further 7 consecutive quarterly VAT returns totalling 79,503 were submitted for the quarters May 2020 to November 2021. A further 2 assessments for quarters ending February 2022 and April 2022 were raised. These totalled 20,887. Surcharges totalling 9,787 have been incurred. No payments were made to HMRC for VAT during the period. PAYE/NIC On 10 February 2020 Modern had an outstanding liability of 46,586. Between 10 February 2020 and 05 February 2022, Modern incurred 48,378 of PAYE/NIC and 124,024 of CIS. Credits totalling 8,000 have been applied, leaving 164,402 outstanding for the period. No payments were made against this liability. Penalties of 200 have been incurred. Detrimental treatment The last set of accounts for year end 31 May 2020 showed modern had trade, bank and other creditors totalling 131,259 and director as owed 18,441 whereas HMRC was owed 112,189. At liquidation the HMRC liability totalled 333,399. Other creditors were owed 122,836. Between 10 February 2020 and 04 April 2022 (the last entry on the bank statements) Modern had banked receipts of 1,728,488 and payments out totalling 1,731,496. No payments were made to HMRC.
