Conduct: Abu Yousuf Choudhury (“Mr Choudhury”) caused Stourport Takeaway Ltd (“Stourport”) to apply for and obtain a government backed bounce back loan (“BBL”) of £50,000 which was more than it was entitled, by submitting false or knowingly inaccurate information contrary to the terms of the BBL, in that: The BBL scheme enabled a business to obtain a BBL of up to 25% of its turnover for the calendar year 2019, up to a maximum amount of £50,000. Where a business was established after 1 January 2019, the applicant could apply the 25% limit to their estimated annual turnover from the date they started their business Stourport was incorporated and began trading on 16 May 2019 so was permitted to use an estimated turnover figure on its BBL application. On 18 July 2020 Mr Choudhury applied for a BBL of £50,000 on behalf of Stourport, declaring estimated turnover of £300,000. Stourport received the £50,000 BBL on 29 July 2020. Mr Choudhury has not provided any records, accounts or other evidence to justify the £300,000 estimated turnover on the BBL application. Mr Choudhury disclosed one bank account held by Stourport, which was only used for the receipt and disposal of the BBL funds. When Stourport entered liquidation on 21 July 2021, it had liabilities of £60,650, including the £50,000 BBL. At least £48,225 of the BBL remains outstanding.
