Conduct: Mr Anthony Mark Sellick (“Mr Sellick”) caused North Yorkshire Classic Ltd (“North Yorkshire”) to fail to comply with its statutory obligations to submit all returns in a timely manner and remit all monies to HM Revenue & Customs (“HMRC”) resulting in HMRC raising assessments totalling £510,932. Mr Sellick caused North Yorkshire to trade to the detriment of HMRC from at least 07 February 2021, in that; Value Added Tax (“VAT”) • North Yorkshire registered for VAT on 15 October 2020. • North Yorkshire failed to submit any VAT returns to HMRC, resulting in HMRC raising assessments for quarter period ending 31 December 2020 through to 31 March 2024, totalling £510,932. • No payments were made towards these assessments. • As a result of the failure to submit VAT returns and make payments, North Yorkshire incurred surcharges from quarter period ending 30 September 2021 to 31 December 2022 totalling £40,915. Corporation Tax (“CT”) • North Yorkshire failed to submit any Corporation Tax returns, resulting in HMRC charging penalties for account period ending 13 May 2020 to 31 May 2023 totalling £2,900. No payments were made towards these penalties. Comparative treatment • Bank statements from 07 February 2021 to 31 March 2024 show that a total of £11,083,766 was paid out of North Yorkshire’s accounts; £10,272,489 in business expenses, £333,177 in personal expenditure, £258,234 to financial institutions (not including the Covid Bounce Back Loan (“BBL”)), £188,514 to connected parties, and £31,058 towards BBL repayments. During the same period, no payments were made to HMRC. • The only payments ever made to HMRC (01 December 2020 & 04 January 2021) totalled £795. • During the period 13 July 2021 to 15 April 2024 North Yorkshire made repayments totalling £31,058 towards the Bounce Back Loan. • At liquidation HMRC stated that the amount due to them was £595,350, and £21,644 due in relation to a Bounce Back Loan.
