Conduct: Harvey Michael Wharton (‘Mr Wharton’) caused Stratosphere Contractors Ltd (“Stratosphere”) to apply for a Government-backed Bounce Back Loan (‘BBL’) of £50,000 to which it was not entitled, by providing false and/or inaccurate information regarding Stratosphere’s turnover in 2019. Furthermore, there is no evidence that the proceeds of the BBL were used in their entirety for the economic benefit of the business, as required under the terms of the BBL scheme. In that: The terms of the BBL scheme were such that an applicant company could obtain a loan of up to 25% of its turnover for the 2019 calendar year, if the applicant had not been established by 1 January 2019, of its estimated annual turnover, and in either case to a maximum value of £50,000. Any BBL so provided was to be used wholly for the economic benefit of the applicant company. Stratosphere was incorporated on 23 March 2019. On 04 July 2020 Mr Wharton applied for a BBL of £50,000 on behalf of Stratosphere stating that Stratosphere’s turnover in 2019 was £200,000. Stratosphere held a business bank account with Bank A. The bank account was opened on 29 April 2019. No transactions were made on the bank account prior to receipt of the BBL. Stratosphere had been established 16 months prior to applying for the BBL and therefore had over 12 months trading from which to estimate it’s turnover. On 21 December 2020 Stratosphere filed dormant accounts at Companies House for the year ending 31 March 2020. Stratosphere was not eligible for a BBL of £50,000. On 7 July 2020 £50,000 of BBL was paid into Stratosphere’s account. In the period between 07 July 2020 and 08 April 2021 Stratosphere received total income (excluding the BBL) of £965.14. Between 07 July 2020 and 08 April 2021, a total of £36,169 was paid out of Stratosphere’s bank account in respect of payments to Mr Wharton, for the benefit of Mr Wharton or connected parties. No evidence has been provided to support these payments were for the sole economic benefit of Stratosphere. At the liquidation date the full amount of the BBL remains outstanding.
