Conduct: On 17 June 2020, Mr Muhammad Hayat ("Mr Hayat") caused Burgers Plus Ltd ("Burgers Plus") to breach the terms and conditions of the Bounce Back Loan ("BBL") scheme by overestimating its turnover on the BBL application, resulting in Burgers Plus receiving more funds than it was entitled to from the BBL scheme. Furthermore, BBL funds totalling £17,700 were not used for the economic benefit of Burgers Plus. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of 25% of turnover. The turnover figure was self-certified by the applicant. Where a business was established after 01 January 2019 it had to provide its estimated annual turnover from the date the business started. • On 17 June 2020 Mr Hayat applied for a BBL on behalf of Burgers Plus declaring estimated turnover of £200,000 which would entitle Burgers Plus to receive the maximum BBL amount of £50,000. • The £50,000 BBL was received into Burgers Plus’ bank account on 18 June 2020. • During the 12-month period immediately prior to the BBL application having been made (between 18 June 2019 and 17 June 2020), Burgers Plus' bank account shows receipts into the bank account which totalled £94,921.14. • Based on the maximum turnover that Mr Hayat would have been aware of in the appropriate period of £94,921.14, Burgers Plus would have been entitled to a BBL in the sum of £23,730, and therefore received £26,270 more than it was entitled to. • The BBL scheme provided that the BBL could only be used for the economic benefit of the business. • Analysis of Burgers Plus’ bank account and responses to enquiries received from Mr Hayat show that £17,700 of the BBL funds received were used to pay Mr Hayat's friends which were stated to be repayment of loans. • Mr Hayat has not provided sufficient evidence to support his explanations and there is no record of loans which were stated to have been received from Mr Hayat's friends being paid into Burgers Plus’ bank account. • Repayments made in relation to the BBL total £6,755. • At the date of the Liquidation Burgers Plus had liabilities totalling £77,226, of which £43,272 related to the BBL.
