Conduct: Mr Ram Bhattarai (“Mr Bhattarai”) breached his duties as the director of Gurkha Wolverhampton Limited (“GW”) by failing to ensure that it complied with legislative requirements in that: • GW did not comply with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 (“the 2006 Act”) resulting in the employment of a person who did not have the right to work. • Home Office Immigration Enforcement (“HOIE”) after investigating GW issued a Notification of Liability for a Civil Penalty of £40,000 in respect of the employment of the worker, payment of which was due on or before 04 March 2025. • GW has not paid the penalty due to HOIE. • Mr Bhattarai was the sole appointed director of GW at the time of the breach of the 2006 Act.
