Conduct: Humaira Ibrahim Khan (“Mrs Khan”) breached the terms of the Bounce Back Loan Scheme by causing Al- Muqit Ltd t/a Basilico (“Al - Muqit”) to make an application for a Bounce Back Loan (“BBL”) resulting in the company receiving a BBL of £50,000 when she knew or ought to have known that  Al - Muqit was not eligible for a loan. Furthermore, Mrs Khan failed to ensure that the entirety of the BBL funds were used for the economic benefit of Al – Muqit. In that:  • The BBL scheme rules allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which those businesses would self-certify when completing the BBL application. Where a business was established after 1 January 2019, an estimated annual turnover could be used from the date the business started. • The applicant also had to declare that the business was carrying on its business on 01 March 2020 that it was engaged in trading or commercial activity in the UK as at the date of the application, and that the business had been adversely impacted by COVID-19. It was a condition of the BBL scheme that funds were to be used for the economic benefit of the business. • Dormant Annual Accounts for financial year ending 31 March 2020 were prepared and filed at Companies House for Al - Muqit.   • Bank statements show no trading income before receipt of the BBL monies on 07 May 2020. • On 06 May 2020 an annual turnover of £400,000 was declared on the BBL application form, applying for BBL funds of £50,000, which was paid into the bank account on 07 May 2020. • There is no evidence that Al - Muqit was eligible for a BBL as it was not carrying on its business on 01 March 2020, engaged in trading or commercial activity in the UK as at the date of the application or been adversely impacted by COVID-19. • On 19 October 2020, the BBL funds were transferred to Al -Muqit’s other bank account. • On 01 February 2021 the BBL funds were transferred back to Al -Muqit’s bank account and immediately paid to a connected third party. No evidence has been provided to confirm that this transaction was for the economic benefit of Al - Muqit. • At liquidation, liabilities totalled £91,262 of which £49,231 was owed to the Bank in respect of the BBL.
