Conduct: Mr Mohammed Ameenul Haque (“Mr Haque”) breached the terms of the Bounce Back Loan (“BBL”) scheme by causing Ameens Estates Ltd (“Ameens”) to overstate its turnover on its application for a BBL, resulting in the company receiving a BBL of £50,000 when he knew, or ought to have known, Ameens was not eligible for a loan of that value, in that: • The BBL scheme terms allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which the applicant would self-certify when completing the BBL application.   • If a company was established after 01 January 2019, they were allowed to estimate the company turnover from the date the company started to trade. • Ameens was incorporated on 15 March 2019. • Mr Haque declared on the company’s BBL application form an estimated annual turnover of £202,500, and consequently on 08 March 2021 Ameens received a £50,000 BBL. • Bank statements show that prior to the BBL being received, the only deposit into the business bank account was £1,000 from Mr Haque. • This would have meant that Ameens would not have been eligible for a BBL as it did not meet the turnover requirement to apply for the minimum BBL of £2,000. • The overstatement of turnover meant that Ameens received £50,000 more than it was entitled to from the BBL scheme. Furthermore, Mr Haque has failed to use the entirety of the BBL obtained by Ameens for the economic benefit of the company, in that: • The terms of the BBL scheme stated that the BBL was to be used only for the economic benefit of the business, used wholly for business purposes and not personal purposes. • The bank balance prior to receipt of the BBL was £1,000. • After receipt of the £50,000 BBL on 08 March 2021, 3 payments totalling £25,000 were made to unknown individuals between 08 March 2021 and 10 March 2021. • Between 14 April 2021 and 29 April 2021 3 payments totalling £25,000 were made to an unknown third-party company. • Of the £50,000 payments made to unknown individuals and third-party companies, at least £49,000 came from BBL funds. • The payments detailed above were not for the economic benefit of Ameens and were contrary to the terms of the BBL scheme. • Ameens entered Creditor’s Voluntary Liquidation on 22 August 2023. • At liquidation, Ameens had liabilities totalling £52,039.18, of which £50,936.02 was owed to the bank in respect of the BBL.
