Conduct: On 26 October 2020, Mrs Eve Demetriou (“Mrs Demetriou”), caused Onbrix Limited (“Onbrix”) to make an application for a Bounce Back Loan (“BBL”) of £47,000 when she knew or ought to have known that Onbrix was not eligible for the BBL, as Onbrix was not engaged in trading or commercial activity on 01 March 2020 or at the date of the BBL application. Furthermore, Mrs Demetriou caused Onbrix to expend the £47,000 BBL funds for purposes that did not provide economic benefit to Onbrix contrary to the terms and conditions of the scheme. In that: Under the BBL scheme, businesses met the eligibility criteria if they were engaged in trading or commercial activity in the UK at the date of the application and were carrying on business on 01 March 2020. Onbrix was incorporated on 09 March 2019. Onbrix filed dormant accounts for the periods ending 31 March 2020 and 31 March 2021. A bank account was opened for Onbrix on 02 October 2020. The bank statements do not show any trading income and Mrs Demetriou states this was the only bank account used by Onbrix. On 26 October 2020, Mrs Demetriou made an application for a BBL of £47,000 on behalf of Onbrix. The BBL application form stated Onbrix’s turnover to be £188,000.  Mrs Demetriou has not provided any documentary evidence to show that Onbrix was trading as at 01 March 2020 or at the date of the BBL application and thus was not entitled to apply for a BBL of any amount. Onbrix received the BBL funds of £47,000 on 27 October 2020. The receipt of the BBL funds was the first transaction on Onbrix’s bank account. Mrs Demetriou has not provided any evidence that the £47,000 BBL funds were used for the economic benefit of Onbrix. On 17 April 2023, Onbrix entered Creditor’s Voluntary Liquidation with total liabilities of £55,300.93, of which £47,216.93 was owed in respect of the BBL.
