Conduct: On 15 May 2020 and 05 January 2021 Vitalijs Kunickins (“Mr Kunickins”) caused Avsmart Fixers Ltd (“Avsmart”) to make Bounce Back Loan (“BBL”) applications totalling £45,000 which he knew or ought to have known did not meet the terms of the scheme. Mr Kunickins made a wrongful declaration by overstating Avsmart’s turnover, as a result Avsmart has received funds that it was not entitled to from the BBL scheme. In that: Avsmart was incorporated on 21 February 2019. Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of their turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or when a business was established after 1 January 2019 it is their estimated turnover from when the business started. Mr Kunickins states that the company started trading 21 February 2019. Dormant accounts were filed at Companies House up to 28 February 2020. Agreed by Mr Kunickins on 11 August 2020. Bank statements for the first year from incorporation to 28 February 2020, shows a turnover of NIL. Bank statement for 01 March 2020 to 15 May 2020 shows a turnover of NIL. Financial Accounts for the year-ended 28 February 2021 show a turnover of £46,578. On 15 May 2020 Mr Kunickins applied for a BBL of £20,000 and declared an estimated annual turnover for Avsmart of £180,000 from the date Avsmart started trading. On 17 May 2020, BBL funds of £20,000 were paid into Avsmart’s bank account. On 05 January 2021 Mr Kunickins applied for a BBL Top-up of £25,000. On 07 January 2021 the BBL Top-up of £25,000 was paid into Avsmart’s bank account. The overstatement of turnover meant that Avsmart received £45,000 more than it was entitled to from the BBL scheme. On 29 November 2023, Avsmart entered Creditors Voluntary Liquidation with known liabilities of £47,283, of which £46,321 is owed in respect of the BBL.
