Conduct: Hamid Yusuf (“Mr Yusuf”) caused Ajey Services Limited (“AJEY”) to trade to the detriment of HMRC in relation to VAT From at least 7 January 2021 and in relation to PAYE/ NIC/CIS from at least 22 May 2021 by failing to make payments as and when they fell due, in that; VAT • Ajey registered for VAT on 24 June 2019. • Ajey submitted VAT returns from quarter ending 08/19 until quarter ending 08/22 after which HMRC raised an assessment for quarter ending 02/23. • Quarter ending 11/20 a return was submitted showing a liability of £131,997.84. HMRC applied a surcharge of £6,185.08 the liability for this period was £138,182.92. Payments were made totalling £19,209.05 which left an outstanding liability of £118,973.87. • Quarter endings 02/21 to 08/22 returns were submitted which showed a total liability of £279,306.20. HMRC applied surcharges to these periods totalling £36,309.94. The total sum of liabilities for these quarters ending was £315,616.14. • Quarter ending 11/22 HMRC applied an assessment of £17,800.42 and a surcharge of £2,670.06 the total sum of liability for this period was £20,470.48. • Quarter ending 02/23 HMRC applied an assessment of £12,163.38. • The last payment towards VAT was on 20 October 2021 of £4,695.72 which was allocated to the quarter ending 02/20. • At liquidation Ajey had liabilities in the total sum of £467,223.87 in respect of VAT and surcharges. PAYE/NIC /CIS • For the year ending 2021/2022 Ajey submitted returns showing a liability totalling £169,552.22 for PAYE/NIC and £21,322.94 for CIS. HMRC applied RTI interest of £548.14 and CIS interest of £47.60. Payments were made totalling £149,990.69 leaving a liability due of £41,480.21. • For the year ending 2022/2023 Ajey submitted returns for the months of April 2022 to December 2022 which showed a liability totalling £61,405.34 for PAYE/NIC and £7,453 for CIS. HMRC applied RTI interest of £600 and CIS interest of £1,000. An employment allowance of £5000 was applied. There were no payments made leaving a liability due of £65,458.34. • The last payment was made on 9 May 2022 of £15,000 which was allocated to the liability of November 2021. • At liquidation Ajey had liability due in relation to PAYE/NIC/CIS of at least £106,938.55 in respect of PAYE/NIC/CIS. Comparative Treatment • At cessation of trade HMRC was Ajey’s largest creditor with debts totalling £498,503.96. • Other creditors debt totalled £91,917.23 of which £23,885 were for Trade and Expense, £35,500 for the director and £32,466.87 for banks and Institutions. • According to the company’s bank statements, between 28 April 2021 to 28 April 2023 payments were received into the bank account totalling £2,213,669.36. • The bank analysis shows the monies paid to individuals totalling £1, 097,057.72, ? £1,097,057.72 paid to Individuals. ? £74,030.95 to the director. ? £146,168.17 payments to connected company. ? £6,520 cash withdrawn from an ATM. ? £247,576.92 to Trade and expense. ? £143,901.81 Unknown transactions. ? £138,457.85 payments to the Bank. ? £1,993.98 to Credit cards. ? £263,175.87 to HMRC of which the last payment was made on 9 May 2022 of £15,000 towards PAYE/NIC/CIS. The last payment towards VAT was on 20 October 2021 of £4,695.72.
