Conduct: On 4 June 2020, Peter Thomas Bowdler (“Mr Bowdler”) caused Modumos Ltd (“Modumos”) to obtain a government-backed Bounce Back Loan (“BBL”) of £50,000 when he knew, or ought to have known, that Modumos was not eligible for any loan under the terms of the BBL Scheme, in that: • Under the BBL scheme a business was able to borrow up to 25% of its turnover in calendar year 2019, up to a maximum of £50,000 and, if the business was established after 1 January 2019, it was to apply the 25% limit to its estimated annual turnover from the date it started. • To be eligible to apply for the BBL, a borrower had to declare the company was carrying on its business on 1 March 2020 and that it was engaged in trading or commercial activity in the United Kingdom as at the date of the application. • The company was incorporated on 18 February 2019 as Go Modular Ltd. • On 24 February 2019, the company’s name changed from Go Modular Ltd to Modumos Ltd. • On 4 June 2020, Mr Bowdler applied for a BBL of £50,000 on behalf of Modumos stating in the loan application that Modumos’ relevant turnover was £250,000. • Modumos’ company bank statements do not indicate that it was carrying on business on 1 March 2020 nor was it trading on 4 June 2020; it was therefore not eligible to apply for a BBL. • On 8 June 2020, funds of £50,000 were credited to Modumos’ bank account. • Modumos submitted dormant accounts for the Year Ended 28 February 2020. • Mr Bowdler has failed to provide any supporting evidence for the estimated turnover figure on the BBL application. • At the date of the liquidation on 27 April 2023, the Statement of Affairs shows that total liabilities amounted to £84,213, of which £51,000 was in respect of the BBL.
