Conduct: On 15 June 2020, Christian Jose De Freitas Franco (“Mr De Freitas Franco”) caused Certified Lettings Ltd (“CLL”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by fraudulently applying for a £50,000 BBL when Mr Franco knew, or ought to have known, that CLL was not eligible for a loan of any amount, and failed to use the entirety of the BBL for the economic benefit of CLL. In that: • Under the BBL scheme, businesses could apply for one loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 01 January 2019, an estimated annual turnover could be used from the date the business started. • The applicant also had to self-certify that the business was carrying on its business on 01 March 2020, that it was engaged in trading or commercial activity in the UK as at the date of the application, and that the business had been adversely impacted by COVID-19. The loan was to be used to provide economic benefit to the business and not for personal purposes. • CLL was incorporated on 13 February 2019, and the first recorded transaction in its bank account was the receipt of the BBL on 18 June 2020. • Mr Franco has failed to provide documentary evidence to show that CLL was carrying on its business on 01 March 2020 and engaged in trading or commercial activity in the UK as at the date of the BBL application, as declared when applying for the loan. • On 15 June 2020, Mr Franco applied to obtain a £50,000 BBL on behalf of CLL, declaring that its estimated annual turnover from the date the business started was £200,000. On 18 June 2020, BBL funds of £50,000 were credited into CLL’s bank account, being the first recorded transaction in the bank account. • Analysis of its bank statements shows that CLL received its first trade related income on 15 November 2021. Between that date and 18 September 2022, CLL received trading related income of £5,000. No further trade related income was received after that date. CLL’s bank account was closed on 25 October 2025. • Mr Franco has failed to provide documentary evidence to show how the turnover figure of £200,000, as declared in the BBL Application, was calculated. • Following receipt of the BBL, between 18 June 2020 and 25 October 2025, at least £34,327 of BBL funds were paid to Mr Franco’s personal bank account. • Mr Franco has failed to provide documentary evidence to show how these funds were used wholly for business purposes and not personal purposes, as declared in the BBL application. • On 28 August 2025, CLL entered Liquidation with liabilities totalling £78,664 of which at least £42,500 was owed in respect of the BBL.
