Conduct: Isa Rafiq HANIF (“Mr Hanif”) caused Apex Active Fitness Limited (“AAF”) to obtain a Bounce Back Loan (“BBL”) of £45,000 using over estimated turnover figures, which resulted in AAF obtaining a BBL that was £42,007 more than it was entitled. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover for the calendar year 2019. The turnover figure was self-certified by the applicant. Or where a business was established after 1 January 2019, 25% limit to the estimated annual turnover from the date of business incorporation. • AAF was Incorporated on 13 February 2019. • Mr Hanif applied for a BBL of £45,000 on behalf of AAF declaring that its estimated turnover for the calendar year 2019 was £182,000. • AAF received the BBL funds of £45,000 on 06 May 2020. • Between 14 March 2019 which was the first recorded transaction on the account and 06 May 2020, a total of £11,971 was received into AAF’s bank account. • Mr Hanif has not provided any evidence to show how the estimated turnover figure of £182,000 was determined. • The over estimation of turnover resulted in AAF receiving at least £42,007 more than it was entitled to from the BBL scheme. • Total liabilities at liquidation amount to £73,931 of which £23,516 relates to the amount owed in respect of the BBL.
