Conduct: On 11 June 2020, Sanjiv Cherian, (“Mr Cherian”) caused Cyberpal App Ltd (“Cyberpal”) to apply for a £50,000 government backed Bounce Back Loan (“BBL”) using overstated turnover figures in the application form, as a result of which the company received BBL funds that it was not entitled to, and following receipt of the BBL the full £50,000 was paid to Mr Cherian between 22 July 2020 and 20 September 2020. In that: • Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of its turnover. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover from the date they started their business. • The company was incorporated on 08 February 2019 and started trading in February 2019. Accounts for the period 08 February 2019 to 29 February 2020 as provided by the Insolvency Practitioner show that the company’s turnover during this period was nil. Therefore, the company was not eligible for a BBL. • On 11 June 2020, Mr Cherian applied for a BBL of £50,000 on behalf of the company. Mr Cherian reported the company’s annual turnover was £974,000. The £50,000 BBL was paid into the company bank account on 18 July 2020. • Under the terms of the BBL scheme, funds were to be used for the economic benefit of the business and not for personal purposes. Following receipt of the £50,000 BBL, between 22 July 2020 and 20 September 2020 £50,000 was paid from the company bank account to Mr Cherian • At liquidation on 17 October 2023, £46,061 of the £50,000 BBL remained outstanding.
