Conduct: Between 6 July 2020 and 3 September 2020 Mr Christian Andrew Barclay (“Mr Barclay”) caused CB Train Engineering Ltd (“CBTE”) to breach the conditions of a Bounce Back Loan (“BBL”) by misusing at least £7,472 of a £20,000 BBL for his own personal benefit and not for the economic benefit of CBTE. In that: On 05 July 2020 CBTE’s business bank account had a nil balance. CBTE received a BBL of £20,000 on 06 July 2020. Between 06 July 2020 and 03 September 2020 total income including the BBL monies into CBTE’s two bank accounts was £27,728. Between 6 July 2020 and 3 September 2020 Mr Barclay withdrew a total of £23,200 for his own benefit, including one payment of £18,000 on 3 September 2020, compared with a total of £12,150 withdrawn by Mr Barclay in the previous three month period 1 April 2020 to 30 June 2020. Consequently, of the £23,200 withdrawn after 6 July 2020 at least £7,472 was funded directly by the BBL funds as opposed to by income from other sources. Mr Barclay completed an application to dissolve CBTE on 26 September 2020 and the company was dissolved on 22 December 2020. ALLEGATION AMENDED IN AGREEMENT WITH DP 16 11 22
