Conduct: Mr Shobbir Ahmed (Mr Ahmed) caused Strience Ltd (the Company) to obtain a government-backed Bounce Back Loan (BBL) of £50,000 when he knew or ought to have known that the Company would not achieve the required turnover. In that: • The BBL scheme permitted a loan of up to 25% of a business’ turnover in the 2019 calendar year or estimated turnover if it had been established after 01 January 2019. • The Company was incorporated and started trading on 11 January 2019. As the Company commenced trading after 01 January 2019, it was entitled to provide an estimate of its annual turnover from the date it started business in the BBL application. • The Company filed accounts for the year ending 31 January 2020 showing turnover of £3,361. • Analysis of the Company bank statements from 1 February 2020 (the day after the last filed accounts) to 16 June 2020 (the day the BBL funds were received) confirms that a total of £4,120 was deposited into the account. Together with the turnover declared in the annual accounts, this gave the Company a total of £7,481 of turnover for 17 months of trading. • Mr Ahmed applied for a BBL of £50,000 on 15 June 2020 stating that the company turnover was £200,000. • Mr Ahmed has provided a summary of the contracts that the Company had in place. Nine of the sixteen pre-BBL application contracts were due to last 3-years. The total commission on all sixteen contracts was £101,808. Based on a contract length of 3-years the yearly commission would have been £33,936. • This would have entitled the company to no more than £8,484 in BBL funding. • The outstanding balance of the BBL at liquidation was £50,635.29.
