Conduct: On 13 May 2020 Mr Wallace caused STRS to apply for a Government backed BBL of £50,000 using an overstated turnover figure which resulted in STRS obtaining a BBL that he knew or ought to have known was at least £34,895.44 more than it was entitled to. Thereafter, the BBL was paid into STRS's bank account on 18 May 2020. In that: • Under the BBL scheme a business could apply for a loan of between £2,000 and £50,000 up to a maximum of 25% of turnover for the calendar year ended 31 December 2019. Where a company was established after 01 January 2019, an estimate of turnover could be used with the applicant required to apply the 25% limit to the estimated annual turnover calculated from the date they started the business. • STRS was incorporated on 11 January 2019. However, it didn't start trading until April 2019. • On 13 May 2020, Mr Wallace applied for a BBL of £50,000 stating a turnover of £200,000. Bank statements showing income from 09 April 2019 were available at the date of the BBL application. • STRS's profit and loss accounts for the period ending 31 January 2020 record a turnover figure of £35,751, and for the period ending 31 January 2021, record a turnover of £20,257. • STRS's bank account statements show that in its first year of trade (09 April 2019 to 09 April 2020), £60,418.23 was received into its bank account. If these receipts constituted the turnover of the Company, then this level of annual turnover would have entitled STRS to receive a maximum BBL in the sum of £15,104.56, rather than the £50,000 it received.
