Conduct: On 29 June 2020 Maciej Synowiec (“Mr Synowiec”) provided false information concerning the turnover of FCZ1 Ltd (“FCZ1”) to obtain a BBL of £50,000 when he knew or ought to have known that FCZ1 was only entitled to a BBL of £6,875, furthermore, not all the BBL funding was used for the economic benefit of FCZ1 in that: • Under the BBL scheme rules, a company that was carrying on business on 01 March 2020 was eligible for one BBL of 25% of its 2019 calendar year turnover, up to a maximum of £50,000. When making an application for a BBL, an applicant had to self-certify the company’s 2019 calendar year turnover. Where a company commenced trading after 01 January 2019, the applicant was entitled to provide a reasonable estimate of Company annual turnover from the date it started business. • FCZ1 was incorporated on 20 December 2018. • Mr Synowiec was appointed as the sole director from incorporation to liquidation. • Bank statements from 18 January 2019, the date of account opening, show income in the first year of trading to 17 January 2020 as £27,501. Based on this, FCZ1 was entitled to a maximum BBL of £6,875. • On 29 June 2020, Mr Synowiec applied for a BBL in the sum of £50,000 having stated that FCZ1’s turnover was £250,000. • By applying for a BBL of £50,000 FCZ1 received £43,125 more than it was entitled to. • The BBL scheme required the applicant to declare that BBL funds would be used in their entirety for the economic benefit of the business, and not for personal use • The BBL proceeds of £50,000 were received on 30 June 2020. • Between 31 July and 10 November 2020, the sum of £30,000 was withdrawn in cash, during the same period, FCZ1 received £7,083, therefore at least £22,543.91 of the cash withdrawals were derived from BBL funds, • Mr Synowiec stated these funds were used for business purposes but has provided no documentary evidence to support this. • Repayments of £11,749 were made towards the BBL • FCZ1 entered Creditors’ Voluntary Liquidation on 18 September 2023 • In liquidation a total of £44,552 is owed in respect of the BBL
