Conduct: On 15 June 2020 Hassan Ali Barakat (“Mr Barakat”) caused ONE TRAINING LIMITED (“OTL”) to apply for a Bounce Back Loan (“BBL”) of £50,000 using an overstated turnover figure, which resulted in OTL obtaining a BBL that was more than it was entitled to. At least £16,000 was transferred to Mr Barakat for purposes that did not provide economic benefit to OTL, in breach of the BBL terms and conditions. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. The terms of the BBL stated that its intended purpose was to provide economic benefit to the business and not for personal purposes. • OTL was incorporated on 17 December 2018. • On 15 June 2020, Mr Barakat applied for a BBL of £50,000 on behalf of OTL declaring that its turnover for the calendar year 2019 was £200,000. • Accounts for the year ended 31 December 2019, which cover the period from 01 January 2019 to 31 December 2019 show a turnover of £8,240. • OTL received the BBL funds of £50,000 on 16 June 2020. • On 16 June 2020, £15,000 was transferred to Mr Barakat, a further £1,000 was transferred to Mr Barakat on 17 June 2020. • Total liabilities at liquidation amount to £71,536 of which £48,728 relates to the amount owed in respect of the BBL.
