In addition, Mr Voke caused Oculis to trade to the detriment of HMRC in respect of Corporation Tax (“CT”), during the period 01 October 2021 to 20 November 2023 (“CT period”), resulting in a CT increase during the CT period of £99,116. In that: PAYE: • During the PAYE period, Oculis submitted 39 PAYE RTI returns with a combined liability of £407,594. • During the PAYE period a further sum of £8,966 was added to HMRC’s claim in respect of penalties and interest. • During the PAYE period, Oculis’ PAYE liability was reduced by £9,000 as a result of employment allowance. • During the PAYE period payments made by Oculis in respect of PAYE totalled £22,248. • During the PAYE period, Oculis’ PAYE liability increased by £385,312. VAT: • During the VAT period, Oculis submitted 11 VAT returns with a combined liability of £253,034, in addition 1 VAT assessment was raised resulting in a liability of £34,514. • During the VAT period surcharges of £15,812 were applied by HMRC with a further sum of £3,534 added to HMRC’s claim in respect of penalties and interest. • During the VAT period payments made by Oculis in respect of VAT totalled £400. • During the VAT period, Oculis’ VAT liability increased by £271,980. Corporation Tax: • Oculis submitted CT returns for the accounting periods ending 31 December 2020 (due for payment on 01 October 2021), 31 December 2021 (due for payment on 01 October 2022) and 31 December 2022 (due for payment on 01 October 2023) with a combined liability of £99,116. • Oculis made no payments to HMRC in respect of the CT liabilities incurred for the accounting periods ending 31 December 2020, 31 December 2021 and 31 December 2022. Differential Treatment: • Accounts for the year ended 31 December 2020 records unsecured creditors of £31,954, a PAYE liability of £32,285, a VAT liability of £16,829 and a CT liability of £18,698. • At the date of administration, the Joint Administrators’ Statement of Proposals for Oculis records preferential creditors of £7,000, unsecured creditors of £33,794, PAYE liability of £417,628, a VAT liability of £302,267 and a CT liability of £115,438. • Oculis’ trial balance for 31 December 2020 records a Director’s Loan Account (“DLA”) of NIL, whilst at the date of administration Mr Voke’s DLA totalled £374,894.
