Conduct: Jenson Phillips (“Mr J Phillips”) caused MASONCAVE LIMITED (“Masoncave”) to obtain a Bounce Back Loan (“BBL”) of £50,000 to which it was not entitled, as it was not trading on 01 March 2020, nor at the time of the application on 31 July 2020, contrary to the terms and conditions of the BBL scheme. The entirety of the £50,000 obtained were used on purposes which did not provide economic benefit to Masoncave, in breach of the BBL terms and conditions. In that: • The BBL Scheme terms and conditions state that applicants applying for a BBL on behalf of the business are required to declare that the business was engaged in trading or commercial activity at the date of the BBL application; had been carrying on business on 01 March 2020 and had been adversely affected by the coronavirus pandemic. • On 04 August 2020, Masoncave obtained a BBL of £50,000. Mr J Phillips declared that Masoncave’s turnover for the calendar year 2019 was £280,000. • Masoncave’s bank account was opened on 27 May 2020 and shows no evidence of trading prior to the date of the BBL application. • Masoncave filed dormant accounts for the period ended 30 November 2019 at Companies House. • Therefore, Masoncave was not trading on 01 March 2020 nor at the time the BBL was received on 04 August 2020, contrary to the terms and conditions of the scheme; and was not entitled to the BBL funds. • From 04 August 2020 to 20 June 2023 net payments totalling £57,500 were made for personal purposes to which £50,000 belonged to the BBL. No evidence has been provided to show that this was for the benefit of Masoncave, contrary to the terms and conditions of the scheme. • Masoncave was placed into compulsory Liquidation on 20 June 2023. • Total liabilities at liquidation amount to £106,762 of which £50,000 relates to the amount owed in respect of the BBL.
