Conduct: Luke Dolan failed to ensure Zanite Air Conditioning (‘Zanite’) complied with its statutory obligations to make payments as and when due to HMRC in respect of Pay As You Earn (‘PAYE’) / Construction Industry Scheme (‘CIS’) and Value Added Tax (‘VAT’) from 1 May 2020 and 12 July 2022. As a result he caused or allowed the company to trade to the detriment of HMRC. In that: The company’s full accounts at end 30 April 2020 show “trade creditors” liabilities of £94,856 and “Corporation Tax” and “other taxes and social security costs” liabilities of £8,708. Between 1 May 2020 and 5 June 2022, Zanite submitted Pay As You Earn (‘PAYE’) / Construction Industry Scheme (‘CIS’) returns totalling at least £240,178.86. There were charges/reliefs applied resulting in a total liability for the period of at least £223,246.24. For the VAT periods ending 07/21 to 04/22, no returns were submitted and HMRC raised VAT assessments totalling £42,734.67. There were charges applied resulting in a total liability for the period of at least £47,378.33. Between 1 May 2020 and 12 July 2022, company bank statements show receipt of £1,878,173.72. In the same period, payments totalling £1,014,275.07 appear to have been made to trade creditors and payments totalling £19,672.02 were made to HMRC. Of the £19,672.02 paid to HMRC, £17,176.83 was paid towards the PAYE/CIS liability detailed above. On 12 July 2022 Mr Dolan resigned as director of Zanite. At this point the total HMRC debt totalled at least £248,104.12. At liquidation, the total HMRC claim is at least £319,202.10 and trade creditors were owed £11,449.95, this is the debt owed to the petitioning creditor.
