Conduct: Nameh Khalil (“Mr Khalil”) caused NKR Accountants Ltd (“NKR Accountants”) to apply for a Bounce Back Loan (“BBL”) of £40,000 to which it was not entitled as the company did not meet the eligibility requirements of the BBL scheme. In that: NKR Accountants was incorporated on 19 November 2018. Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. NKR Accountants’ financial statements for the year ending 31 October 2019 show a turnover of £5,943. NKR Accountants’ financial statements for the year ending 31 October 2020 show a turnover of £1,426. Mr Khalil applied for a BBL of £40,000 on behalf of NKR Accountants using an estimated turnover figure of £160,000. Based on the financial statements for the year ending 31 October 2019, NKR Accountants was not entitled to apply for a BBL as it did not meet the criteria for the minimum loan amount and was not entitled to estimate turnover as it was established prior to 1 January 2019. On 27 July 2020, funds of £40,000 were credited to NKR Accountants bank account. At the date of liquidation on 9 August 2022, a total of £37,631 was due to creditors, of which £37,131 was due in respect of the BBL.
