Conduct: On 22 June 2020 George Richard Edmund Barton (“Mr Barton”) caused Twysec Ltd (“Twysec”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover on the BBL application, when Mr Barton knew or ought to have known that Twysec was not entitled to a BBL of £50,000 based on its turnover, and as a result Twysec received BBL funds that it was not entitled to. In that:   • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it is their estimated annual turnover from the date that the business was started. • Twysec was incorporated on 05 November 2018 at which time the company commenced trading and as such was required to state its turnover for the calendar year 2019 in the BBL application. • On 22 June 2020 Mr Barton made a BBL application in the amount of £50,000 on behalf of Twysec declaring turnover of £200,000 and with Twysec receiving the BBL funds of £50,000 into its bank account on 26 June 2020. • Accounts for Twysec for the years ending 31 December 2019 show turnover of £3,826. Based on Twysec’s 2019 turnover the company was not entitled to make a BBL application. • Twysec entered Creditors Voluntary Liquidation on 26 August 2025 with an outstanding BBL of £37,486 including interest charged.
