Conduct: On 13 July 2020, Oana Cozma (“Ms Cozma”) caused St Helens Cleaning Limited (“St Helens”) to obtain a £50,000 Bounce Back Loan (“BBL”) by overstating St Helens’ turnover, when she knew or ought to have known that St Helens was not eligible for this amount. As a result, St Helens received £44,934.21 more than it was entitled to. In that: • Under the BBL scheme, businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 01 January 2019, an estimated turnover could be used. • St Helens was incorporated on 26 October 2018 and started trading the following month. • On 13 July 2020, Ms Cozma made an application to obtain a £50,000 BBL on behalf of St Helens, declaring that its turnover for the calendar year 2019 was £260,000. The funds were credited into St Helens’ bank account on the following day. • Unaudited financial statements for the year ending 31 October 2019 show that St Helens had a turnover of £26,656.00 during the first year of trading. • Analysis of St Helens’ bank account shows that between 01 January 2019 and 31 December 2019, St Helens received sales income of £20,263.15. • Based on the income received in its bank account during calendar year 2019, St Helens was entitled to apply for a BBL of no more than £5,065.79. • The overstatement of turnover meant that St Helens received £44,934.21 more than it was entitled to from the BBL scheme. • St Helens entered liquidation on 02 February 2024 with liabilities totalling £51,582.60 of which £37,034.30 relates to the amount owed in respect of the BBL.
