Conduct: Amit Navinchandra Haria (“Mr Haria”) failed to ensure that Hill Street Services Limited (“HSS”) complied with its statutory obligations to settle all its PAYE liabilities as and when due and caused HSS to trade to the detriment of HM Revenue and Customs (“HMRC”) in respect of PAYE from 22 September 2019 to liquidation on 17 August 2022. In that: PAYE • Returns for PAYE were submitted for months August 2019 to August 2022 totalling £1,981,974. • No payments were made to HMRC in respect of PAYE. • Including charges and penalties the total outstanding liability to HMRC in respect of PAYE was £2,034,877. • At the date of liquidation, £86,830.46 remained outstanding to HMRC in respect of VAT including surcharges. Comparative Treatment • A review of the available company bank statements shows that for the period between 22 September 2019 to 30 November 2021, excluding contra entries, at least £491,989 was paid out of the company bank account to trade creditors and no monies were paid to HMRC. • At liquidation, HSS had creditors totalling £2,100,398 of which £2,034,877 was owed to HMRC.
