Conduct: On 10 October 2020, Mr Md Shahjan Ahmed (“Mr Ahmed”) breached the terms of the Bounce Back Loan (“BBL”) scheme by causing Curry Online Limited (“COL”) to overstate its turnover on the BBL application, resulting in COL obtaining a government-backed BBL of £50,000 when he knew, or ought to have known, the COL was not entitled to a BBL of that amount, in that: • The terms of the BBL Scheme stated that a business could apply for a loan of up to 25% of the Company’s turnover, from a minimum of £2,000, up to a maximum of £50,000. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or, where a business was established after 01 January 2019, it was their estimated turnover. • COL was incorporated on 18 October 2018 and began trading on or around that date. Mr Ahmed was appointed as COL’s sole director on the same date and remained in office until liquidation. • As a company trading prior to 01 January 2019, the BBL application required a turnover figure for the 2019 calendar year. COL was not permitted to estimate turnover. • According to COL’s bank statements, trade credits received in the 2019 calendar year came to a total of £60,190. • According to its financial accounts for the year ended 31 October 2019, COL’s turnover was £83,246. Mr Ahmed approved the year-end accounts on 17 June 2020. Turnover in that amount entitled Curry to apply for a maximum BBL of £20,811.50. • On 10 October 2020, Mr Ahmed submitted a BBL application on behalf of COL declaring turnover of £210,000 and requested a BBL of £50,000. • On 13 October 2020, the BBL monies of £50,000 were credited to COL’s bank account. • Total liabilities at liquidation were £50,010, of which £43,546 relates to the outstanding BBL.
