Conduct: 1. Mr Thorne caused SN Films to breach the terms of the Bounce Back Loan (“BBL”) scheme by making a false declaration in overstating SN Films’ turnover on its application for a BBL. This resulted in the company receiving a BBL of £50,000 when he knew, or ought to have known, that SN Films was not eligible for a loan of that value, in that: 7.1 Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 the 25% limit was to be applied to the estimated turnover from the date the business started. 7.2 SN Films was incorporated on 18 October 2018. Bank statements show that the first transaction into the Company bank account was 17 December 2018. If the Company was established prior to 01 January 2019 it was required to use its actual turnover for the calendar year 2019 on the BBL application. 7.3 Mr Thorne has stated that the Company started film production on 28 January 2019. If the Company is deemed to be established after 01 January 2019, then the Company would have been eligible to use an estimated annual turnover from the date the business started. 7.4 On 04 September 2020, Mr Thorne applied for a BBL of £50,000 on behalf of SN Films declaring an annual turnover of £270,000, and consequently on 07 September 2020 SN Films received a £50,000 BBL. 7.5 Unaudited financial statements for the period 18 October 2018 to 28 February 2020 state that the company had a turnover of £205. 7.6 When SN Films entered Creditor’s Voluntary Liquidation on 31 August 2022 it declared liabilities of £58,042.97, of this £49,019.60 was owed to the bank, as per the Statement of Affairs. 7.7 The bank claimed £49,682.73 in the Liquidation in respect of the BBL.
