Conduct: On 08 February 2021 Salma Khan, also known as Salma Ali Abbas Khan, (“Mrs Khan”) caused Digital Rose Limited (“Digital”) to make a Bounce Back Loan (“BBL”) application of £50,000 when she knew or ought to have known that Digital was not eligible for this amount. By overstating Digital’s turnover, Mrs Khan caused Digital to receive more funds than it was entitled to from the BBL scheme. In that: • Digital was incorporated on 18 October 2018. • Mrs Khan states that the company started trading in February 2019. • A business could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover in calendar year 2019 or if the business commenced after 01 January 2019 the 25% limit was applied to its estimated annual turnover from the date the business started. • Bank statements for the period March 2019 to March 2020 from two bank accounts show a turnover of £47,051 into the company bank account. Based on this turnover, Digital was entitled to apply for a BBL of £11,763. • On 08 February 2021 Mrs Khan applied for a BBL of £50,000 on behalf of Digital declaring that its annual turnover for Digital for 2019 was £200,000. By overstating Digital’s turnover, Mrs Khan caused Digital to receive £38,237 more that it was entitled to. • On 09 February 2021, the BBL of £50,000 was paid into Digital’s bank account. • The repayments made towards the BBL was £5,192. • On 15 November 2022, Digital entered Creditors Voluntary Liquidation with known liabilities of £63,690, of which £45,672 is claimed by the bank as owing in respect of the BBL.
