In that: • Under the BBL scheme, businesses were able to apply for a BBL if they were engaged in trading or commercial activity in the UK at the date of the application, were carrying on business on 01 March 2020 and had been adversely affected by Covid. • BJC was incorporated on 16 October 2018. • On 11 June 2020, Mr Church applied for a BBL of £25,000 on behalf of BJC declaring that its turnover for the calendar year 2019 was £100,000. • BJC’s bank account statements show that BJC was not actively trading until May 2021 meaning that BJC was not eligible to access the BBL scheme. • BJC received the BBL funds of £25,000 on 11 June 2020. • Total liabilities at liquidation amount to £71,131.27 of which £25,000 relates to the amount owed in respect of the BBL. • At the date of liquidation, on 27 May 2021, the BBL remained unpaid.
