Conduct: On 08 June 2020, Ms Dayanni Andrade Melo (also known as Ms Dayanni Melo) (“Ms Melo”) caused DMRS Lettings Ltd (“DMRS”) to overstate the turnover of the company to enable it to obtain a Bounce Back Loan (“BBL”) of £50,000 when she knew or ought to have known that the company was not entitled to a loan of that amount. Furthermore, Ms Melo failed to ensure the BBL funds were used for the economic benefit of DMRS, in that: • Under the BBL scheme, businesses could apply for a BBL of up to 25% of their 2019 turnover, from a minimum of £2,000 to a maximum of £50,000. Businesses incorporated after 01 January 2019 were asked to estimate their turnover from the date the business started. • DMRS was incorporated on 15 October 2018. • On 08 June 2020, Ms Melo applied for a £50,000 BBL on behalf of DMRS, declaring its turnover as £250,000. • On 09 June 2020, DMRS received the £50,000 BBL funds into the company bank account. • An analysis of DMRS’ bank account shows that between 23 January 2019 (first bank account receipt in the 2019 calendar year) and 31 December 2019, DMRS received trading income of £27,855. • DMRS was therefore entitled to apply for a maximum BBL of £6,964 and received £43,036 more than it was entitled to. • The BBL scheme required the funds to only be used to provide economic benefit to the business and not personal purposes. • Prior to the receipt of the BBL, the balance in the account was £11,102.31 • Between 27 July 2020 and 04 September 2020, £35,000 was transferred to Ms Melo, during which DMRS received £3,441.55 as trading income into the account • Ms Melo has failed to evidence how at least £20,45635,000 of the BBL funds received was used for the economic benefit of DMRS. • DMRS made BBL repayments of £11,858.58 • DMRS entered Creditors Voluntary Liquidation on 04 November 2024 with liabilities of £51,200, of which £42,000 related to the BBL.
