Conduct: On 06 October 2020 Atanas Evaeniev Ivanov (“Mr Ivanov”) whilst acting as a director caused M Secunda Ltd (“M Secunda”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover on the BBL application, when Mr Ivanov knew or ought to have known that M Secunda was not entitled to a BBL of £47,500, resulting in M Secunda receiving more BBL funds than it was entitled to. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019. • The company was incorporated on 09 October 2018, filing accounts from incorporation to 31 October 2019. • M Secunda’s bank statements for the period 01 January 2019 to 31 December 2019 shows sales income of £55,048 and therefore the company would have been eligible for a maximum BBL of £13,762. • On 06 October 2020 Mr Ivanov applied for and obtained a BBL of £45,000 stating M Secunda’s turnover for 2019 was £190,000. The BBL application was electronically signed by the registered director as at this date however Mr Ivanov has stated that he made the application. Mr Ivanov was formally reappointed as a director of M Secunda on 07 October 2020 and signed the BBL agreement on 08 October 2020. • On 08 October 2020, a BBL of £45,000 was paid into M Secunda’s bank account. • On 08 December 2020 a top-up BBL of £2,500 was paid into M Secunda’s bank account. • M Secunda received BBL monies of £33,738 more than it was eligible for. • On 10 May 2024 M Secunda entered Creditors Voluntary Liquidation with known liabilities of £53,361, of which £47,301 is owed in respect of the BBL.
