Conduct: On 26 May 2020 Marius Catalin Iliuta (“Mr Iliuta”) caused B & DM Ltd (“BDM”) to apply for a Bounce Back Loan (“BBL”) of £50,000 when he knew or ought to have known BDM was not eligible for the scheme. There is no evidence that the BBL funds obtained were used for the economic benefit of BDM, as was required by the terms of the BBL scheme, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. • Mr Iliuta was the sole appointed a director of BDM from incorporation on 24 September 2018. • On 26 May 2020, Mr Iliuta applied for a BBL of £50,000 on behalf of BDM declaring that its turnover for the calendar year 2019 was £201,000. • Accounts for year ended 31 March 2019 reported turnover of £68,527 • Accounts for year ended 31 March 2020 reported turnover of £82,900 • BDM received the BBL funds of £50,000 on 28 May 2020. • On 19 June 2020 £50,000 was transferred to Mr Iliuta marked as “devidente.” There is no evidence this was used for the economic benefit of BDM. • Total liabilities at liquidation amount to £41,600 of which £39,000 relates to the amount owed in respect of the BBL
