Conduct: Gheorghe Rusu (“Mr Rusu”) caused Girusir Ltd (“GL”) to overstate its turnover in an application to obtain a government-backed Bounce Back Loan (“BBL”) of £50,000 when he knew or ought to have known that GSL was not eligible for a BBL based on its turnover of more than £17,436. In that: • Under the BBL scheme rules, a company could borrow between £2,000 and a maximum of £50,000 based on 25% of the company’s turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 01 January 2019 it is their estimated annual turnover from the date that the business was started. • GL commenced trading on 06 September 2018 and therefore, was required to use its turnover in the calendar year 2019 for the purpose of obtaining BBL funds. • Mr Rusu was appointed as a sole director on 06 September 2018 and remained as such until GL dissolved on 25 May 2024. • On 27 January 2021 Mr Rusu applied for a BBL of £50,000 from a BBL lender. On the application, Mr Rusu certified that the Company’s 2019 calendar year turnover was £212,580. • GL’s Financial Statements for the year ended 30 September 2019 and 2020 record that the GL had a turnover of £62,324 and £54,959 respectively. • Analysis of the GL’s bank account shows that GL received £69,745 in the 2019 calendar year (11.01.19 to 30.12.19). • Based on a turnover of £69,745, GL was eligible for a BBL of £17,436. GL therefore received £32,564 more in BBL funds than it was entitled to. • The BBL remains outstanding, and the BBL lender are creditors in the Company’s liquidation for £49,742.18.
